These Terms & Conditions (“Terms”) apply to your use of The Homage Collection website and your purchase of products from The Homage Collection Pty Ltd (“The Homage Collection”, “we”, “us” or “our”).

By using our website or placing an order with us, you agree to these Terms. If you do not agree to these Terms, you should not use our website or purchase our products.

1. About The Homage Collection

The Homage Collection creates luxury collectible furniture incorporating detailed representations of iconic sporting venues.

Our products may be produced in limited quantities and may be offered through defined purchasing windows.

Because our products are made to order, production does not commence until the relevant purchasing window has closed and the required payment has been received.

2. Product information

We make every reasonable effort to ensure that product descriptions, specifications, images and other information on our website are accurate. However, photographs and digital representations may not perfectly represent the appearance of a physical product.

Minor variations may occur in:

• timber grain;
• colour;
• finishes;
• lighting;
• 3D-printed components;
• textures;
• materials; and
• other handmade or manufactured components.

Such variations do not necessarily constitute a defect.

We reserve the right to make reasonable improvements or modifications to product specifications where required for manufacturing, quality, safety or performance purposes.

3. Limited editions

Certain Homage Collection products may be released as limited editions. Where a product is described as limited edition, production will be limited to the quantity specified for that edition.

Each table may be individually numbered or otherwise identified as part of its relevant collection.

Once an edition has sold out, we may not reproduce that edition in the same form.

4. Purchasing windows

Certain collections may be available for purchase only during a defined purchasing window. The purchasing window will be communicated on the relevant product or collection page. Orders placed during a purchasing window secure a production allocation, subject to successful payment and acceptance of the order. Once the purchasing window closes, production will commence.

5. Deposits and payment

Unless otherwise stated, a 50% deposit is required when an order is placed. The remaining 50% balance will be charged once the relevant purchasing window has closed and prior to production commencing.

By placing an order, you authorise us or our nominated payment provider to process the applicable payments using the payment method provided.

All prices are displayed in Australian dollars unless otherwise stated.

6. Order acceptance

Submitting an order constitutes an offer to purchase a product. An order is not considered accepted until we have confirmed the order and received the required deposit.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

• payment cannot be processed;
• incorrect pricing has been displayed;
• a product is unavailable;
• there has been an obvious website or system error;
• we reasonably suspect fraudulent activity; or
• we are unable to fulfil the order.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled order.

7. Made-to-order products

Our tables are made to order. Once production has commenced, the product is manufactured specifically for your order and may not be capable of being cancelled or resold in the same manner as a standard retail product. For this reason, cancellation rights after production has commenced may be limited, subject always to your rights under the Australian Consumer Law.

8. Production timeframes

Following closure of the relevant purchasing window, the expected production and delivery timeframe is approximately:

• 2 weeks - wooden table fabrication;
• 1 weeks - stadium 3D printing, colouring and assembly;
• 1 weeks - lighting installation;
• 3 weeks - final assembly, inspection and quality control; and
• 3-4 weeks - shipping and White Glove Delivery.

This represents an estimated total timeframe of approximately 10–11 weeks from the close of the purchasing window. These timeframes are estimates only and may vary due to manufacturing, freight, customs, weather, supplier, logistical or other circumstances outside our reasonable control. We will endeavour to keep customers informed of significant changes to expected delivery timeframes.

9. Delivery

All Homage Collection tables are delivered using our White Glove Delivery service.
White Glove Delivery includes:

• delivery to your residential address;
• bringing the table into your home;
• assembly of the table;
• positioning of the table;
• removal of protective packaging; and
• removal of delivery rubbish and packaging materials.

Because of the size, weight, complexity and value of our tables, we only provide White Glove Delivery. We believe the delivery experience should reflect the quality and nature of the product and ensure the table is handled appropriately from our facility through to its final position in your home.

10. Delivery requirements

You are responsible for ensuring that the delivery location is reasonably suitable for receiving the table.

Before delivery, you should ensure that:

• there is sufficient access to the property;
• doorways and hallways are sufficiently wide;
• lifts or stairways can accommodate the table;
• the delivery path is reasonably clear;
• there is a suitable location for the table; and
• any relevant building or strata requirements have been addressed.

If specialist equipment or additional delivery services are required because of access restrictions, additional costs may apply. We may contact you before delivery to confirm access requirements.

11. Risk and title

Subject to your rights under the Australian Consumer Law, ownership of the product passes to you once full payment has been received.

Risk in the product remains with The Homage Collection until delivery to you.
We will take reasonable steps to ensure that your table is appropriately protected during transportation and delivery.

12. Warranty and Australian Consumer Law

Our products are covered by the consumer guarantees provided under the Australian Consumer Law where applicable. Nothing in these Terms is intended to exclude, restrict or modify any right or remedy you may have under the Australian Consumer Law that cannot legally be excluded, restricted or modified. Additional warranty information may be provided with your product or separately published by The Homage Collection.

13. Product care

The customer is responsible for following the product care and operating instructions supplied with the table.

Damage resulting from misuse, incorrect installation, modification, accidents, unreasonable use or failure to follow care instructions may not be covered by any applicable manufacturer's warranty, subject always to your rights under the Australian Consumer Law.

14. Intellectual property

All content on the The Homage Collection website, including:

• photographs;
• product designs;
• logos;
• trademarks;
• graphics;
• written content;
• videos;
• illustrations;
• product concepts; and
• website design

is owned by or licensed to The Homage Collection or its relevant rights holders.
You may not reproduce, modify, distribute, sell or commercially exploit our intellectual property without our prior written permission.

15. Sporting team and venue intellectual property

The Homage Collection may create products in collaboration with or under licence from sporting organisations, teams or venues. Any relevant trademarks, logos, names, imagery or intellectual property remain the property of their respective owners. Nothing on our website grants you any ownership or licence to use those intellectual property rights independently.

16. Website use

You agree not to:

• use our website for unlawful purposes;
• interfere with website operation;
• attempt to gain unauthorised access to our systems;
• introduce malicious software;
• copy or reproduce website content without permission; or
• use our website in a way that may damage The Homage Collection or its customers.

17. Limitation of liability

To the maximum extent permitted by law, The Homage Collection will not be liable for indirect, incidental or consequential loss arising from your use of our website or products. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including the Australian Consumer Law.

18. Events outside our control

We are not responsible for delays or failures caused by circumstances outside our reasonable control.

These may include:

• natural disasters;
• severe weather;
• international freight disruptions;
• customs delays;
• port congestion;
• manufacturing interruptions;
• supplier disruptions;
• industrial disputes;
• government restrictions;
• pandemics;
• transport disruptions; or
• other unforeseen circumstances.

Where such an event occurs, we will take reasonable steps to minimise the impact and keep affected customers informed.

19. Changes to these Terms

We may update these Terms from time to time. The Terms applying to your purchase will generally be the Terms in effect when your order is accepted, unless otherwise required by law. The latest version of these Terms will be published on our website.

20. Governing law

These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the jurisdiction of the courts of Western Australia, subject to any rights you may have under applicable consumer protection legislation.
